The driver accused of driving drunk and causing a crash that killed two of his friends in Avila Beach is scheduled for a pre-preliminary hearing Monday morning.

Chico State student Evan Green, 21, has pleaded not guilty. He is charged with four felony counts, including two counts of gross vehicular manslaughter while intoxicated.

In a pre-preliminary hearing, both the defense and the prosecution see if the case can be resolved by a plea. The defense may ask for information and evidence from the prosecution, called discovery.

The crash happened on June 17th off of Avila Beach Drive. Police say Green had an expired license since 2009, as well as a criminal record including drug and alcohol charges. Aaron Beaver of Eureka and Marcus Nelson of Castro Valley, both 21 years old, were killed.

The suspected drunk driver in Friday morning's deadly crash in Avila Beach pleaded not guilty Wednesday morning to the charges against him and is currently out on $150,000 bail, according to our KSBY News crew in the courtroom.

Evan Green, who is a construction management major at California State University, Chico, appeared in a San Luis Obispo County courtroom. Green is facing four felony counts, including two counts of gross vehicular manslaughter while intoxicated. He also faces one misdemeanor count of driving while unlicensed.

Green was initially booked into jail on suspicion of murder. According to the San Luis Obispo County District Attorney's Office, the current complaint was filed based on what prosecutors believe they can prove beyong a reasonable doubt. The district attorney's office says it could ammend the complaint if additional facts or circumstances come to light.

Green is accused drinking and driving, and then crashing onto the grounds of the Avila Beach Golf Course, killing two passengers, 21-year-old Aaron Beaver of Eureka and 21-year-old Marcus Nelson of Castro Valley. One other passenger survived.

A preliminary report released by the CHP states two breath tests showed Green had a blood alcohol content of .245 and .232. The report also shows Green has a criminal history, including an arrest for driving with a BAC of .05 at age 17, and has had an expired license since 2009.

Green is due back in court for a pre-preliminary hearing July 11.

A preliminary investigation report on the driver of last week's deadly crash in Avila Beach says tests showed 21-year-old Evan Green had a blood alcohol content of between .232 and .245.

The CHP says Green, who's from Chico, has had an expired license since 2009. According to the San Luis Obispo County Sheriff's Department website, Green was booked on suspicion of murder. The crash early Friday morning killed 21-year-old Aaron Beaver of Eureka and 21-year-old Marcus Nelson of Castro Valley. One other passenger in the car survived.

The report shows Green has a criminal record, which includes a conviction for minor in possession of alcohol in 2009. He was arrested at age 17 for driving with a blood alcohol level of .05. The case went to diversion. Green was also arrested in 2007 for public intoxication/under the influence of drugs. The case was again sent to diversion.

The report shows Green and his three friends had been drinking at bars in downtown San Luis Obispo before the crash. At the time of the crash, the report says they were headed back to a vacation home in Avila Beach owned by Green's family.

At the crash scene, officers asked Green if he was injured. It says he stated "Yeah I'm hurt but they are still in there. I was the designated driver and I'm not intoxicated so don't worry about me. Just help them."

According to the website for the San Luis Obispo County Sheriff's Office, the suspected drunk driver in Friday morning's deadly crash in Avila beach was booked into jail on murder charges without bail Saturday and was not properly licensed.

Evan Green, 21, of Chico and another passenger survived when Green lost control and rolled onto the grounds of the Avila Beach Golf Course. Two other people in the car, 21-year-old Aaron Beaver of Eureka, and 21-year-old Marcus Nelson of Castro Valley, were killed in the crash.

Driver identified, suspected of DUI in overnight fatal crash

According to the California Highway Patrol, 21 year old Evan Green of Chico was driving a 2004 Saturn Vue westbound on Avila Beach Drive when he crashed killing two of his passengers.

The CHP says Green had difficulty making a right hand curve on Avila Beach Drive just past Cave Landing Road around 2:00 Friday morning. Green over corrected, causing the vehicle to roll several times onto the grounds of the Avila Beach Golf Resort.

Two unidentified passengers inside the car were killed during the crash. Green, and a 3rd passenger, Jacob Zimmer of Castro Valley were taken to Sierra Vista with major injuries.

Green was arrested and charged with Felony DUI and other related charges.

UPDATE: CHP plans road closure after double fatal crash in Avila Beach

The California Highway Patrol says it plans to close down westbound Avila Beach Drive Friday morning, as it investigates an overnight fatal crash.

The crash happened around 2:10 a.m. on Avila Beach Drive just west of Cave Landing Road. CHP says two young men were killed, and two other have major injuries.

There is no information yet about the identities of the men, but CHP says all four men are "young".

Two young men are dead and two have major injuries after a crash overnight in Avila Beach.

The California Highway Patrol said the call came in around 2:10 a.m. Friday. It happened on Avila Beach Drive, just west of Cave Landing Road.

CHP won't give specific age details, but says all four men are "young".

Emergency crews used the jaws of life to get the people out of the car.
