The Santa Barbara County District Attorney's Office says Canada has denied the U.S. Department of Justice's request to extradite actor Randy Quaid and his wife, Evi.
In September 2010, the couple was arrested on charges of felony vandalism, stemming from an incident where officers say the Quaids were found squatting in the guest house of a home they once owned in Montecito.
The couple posted bail and were released pending arraignment in Santa Barbara Superior Court. But then, the Quaids fled to Canada, where Evi is a citizen. Based on their failure to appear in court, warrants were issued for their arrest.
The Santa Barbara County District Attorney's Office applied to have the USDOJ request the couple be extradited from Canada. Friday, the USDOJ notified the district attorney's office that the request has been denied.
The bench warrants for the Quaids remain out. If the couple returns to the U.S., they will be arrested, according to the district attorney's office.

SANTA BARBARA, Calif. (AP) -- It's another missed court date, another arrest warrant for Randy Quaid's wife, Evi.
The 47-year-old failed to appear for a probation hearing Thursday in Santa Barbara and faces a new $100,000 arrest warrant, Deputy District Attorney Anthony Davis said.
At the hearing, Evi Quaid's attorney, Robert Sanger, withdrew from the case. He declined comment Friday in an e-mail.

Randy and Evi Quaid are wanted in the coastal city for a felony vandalism case in which they're accused of causing more than $5,000 damage to the guest house of a home they once owned. Neither has shown up for any court hearings since a criminal case was filed in October and have already forfeited $1 million in bail.
They remain in Canada, where they are seeking asylum from a group they have dubbed the "Hollywood star-whackers."
Randy Quaid faces immigration hearings there to determine whether he should be allowed to remain in Canada and whether he should be granted refugee status. His next hearing is scheduled for Dec. 22.
Evi Quaid, who is on probation for a misdemeanor defrauding an innkeeper case in Santa Barbara, has indicated she doesn't want to leave her husband to deal with the California case.
Randy Quaid is the older brother of actor Dennis Quaid. He is best-known for his roles in films such as "National Lampoon's Vacation" and "Independence Day," but won a Golden Globe award - which he brought to court during one of his appearances in the innkeeper case - for his depiction of President Lyndon Johnson in a TV movie in the late 1980s.

SANTA BARBARA, Calif. (AP) - Randy Quaid and his wife remain fugitives from a California court after the couple failed to appear for their arraignment on felony vandalism charges for the fourth time.
A judge refused to schedule a new date for the couple, instead leaving their arrest warrants active.
The actor's attorney, Robert Sanger, said Quaid's passport had been confiscated by Canadian authorities, where the pair are seeking asylum.
Randy and Evi Quaid are charged with felony vandalism stemming from a September arrest after they were accused of damaging the guest house of a hillside Santa Barbara home they used to own.
They were arrested last month in a posh neighborhood in Vancouver and are seeking asylum from a group they have described as "Hollywood star-whackers."

Randy Quaid and his wife, Evi, are scheduled to appear in a Santa Barbara County courtroom Tuesday morning, but will they show up?
The couple has been known to skip out on court appearances in the past.
The Quaids were arrested in Canada last month. They have been seeking asylum there because they claim their lives are in danger back in the states.
The couple faces felony burglary charges for reportedly squatting in the guest house of their old home in Montecito, which they no longer own.

Actor Randy Quaid and his wife Evi have failed to appear for an arraignment
in their felony vandalism case.
The Santa Barbara County District Attorney's office says the couple did not appear in a Santa Barbara court Tuesday morning. The Quaids' attorney said the actor was required to stay in Canada until he can appear for an immigration hearing there Nov. 8.
A judge issued a bench warrant for Evi Quaid after determining that she did not have a good reason to miss Tuesday's hearing.
Randy Quaid is due back in court Nov. 16. Each faces a felony vandalism charge after their September arrest for allegedly squatting in the guest house of a home they
used to own.
They have said they are seeking asylum in Canada, claiming they fear a group they have described as "Hollywood star whackers."

SANTA BARBARA, Calif. (AP) - Randy Quaid and his wife are due back in a Santa Barbara courtroom for an arraignment on felony vandalism charges, but it remains unclear whether the couple will return from Canada for the hearing.
The Quaids have been staying in Vancouver and in recent weeks have publicly claimed their lives are in danger. They posted $1 million bail to guarantee their appearance Tuesday.
Randy and Evi Quaid have a history of missing court appearances, which led a judge last month to set a high amount to try to guarantee their attendance at an arraignment. Each is charged with vandalizing a home they once owned and were found squatting at in September.
The Quaids have said they are being persecuted by a group of "Hollywood star whackers" and fear for their lives.

Actor Randy Quaid and his wife Evi are out on bond in Canada.
The couple had been in an immigration holding facility in Vancouver since their arrest Friday. Both were picked up on a warrant out of Santa Barbara County, where they're wanted for skipping out on a court date last week. The pair is facing felony burglary charges for reportedly squatting in the guest house of their old home in Montecito, which they no longer own.
Now the Quaids say they want refugee status in Canada, because they fear for their lives, and a new discovery in Evi Quaid's history may make getting that status just a little bit easier.
"Miss Reed in immigration profoundly pointed out that I am in fact entitled to Canadian citizenship," Evi Quaid said Wednesday.
It sounds like a story fit for the big screen, but according to the couple's attorney, Evi Quaid's father was born in Canada. That makes Evi eligible for dual citizenship.
"I'm just so proud," she said, "because I love Canada, I really do."
But the couple is not out of the woods just yet. Randy Quaid must return for an immigration hearing November 8, and both still face felony charges in Santa Barbara County.
"I've got some new options that are open to me and I need to weigh everything," Randy Quaid said, referring to the possibility of also becoming a citizen in Canada, and leaving the U.S.
The Quaids say they want refugee status in Canada because they fear for their lives back in the U.S. During their first immigration hearing, Evi said eight of her husband's acting friends had been murdered, and that 'star whackers' would soon be coming after them. The couple have brought no evidence to the table to prove this.
Like any good movie mystery, only time will tell what happens next in the Quaid saga.
Back in Santa Barbara County, both Randy and Evi Quaid are wanted on half-million dollar bench warrants.

The pair had appeared at an immigration hearing in which they requested refugee status based on their belief that they were being persecuted by "Hollywood star whackers," as they put it, and that their lives were in danger.

The Quaids were arrested last month in Montecito after they were reportedly found living in the guest house of their old home, that they no longer own.
After Thursday's arrest in Vancouver their lawyer, Brian Tsuji, had this to say, "This is a statement from Evi and Randy Quaid. It's for the world press. Thank you for coming. And it's, yes, we are requesting asylum from Hollywood 'star whackers.'" When asked to define the term 'star whackers', Tsuji stated that he was simply reading what was written.
The couple is free on bond until another hearing on Thursday.

SANTA BARBARA, Calif. (AP) - Authorities say Randy Quaid and his wife have been released on bail after their weekend squatting arrests for moving into a home they allegedly sold years ago in Southern California.
Santa Barbara County sheriff's spokesman Drew Sugars says the Quaids were arrested Saturday after an alarm went off at the Montecito home and the couple was found living in a guest house.
The 59-year-old actor known for roles in "National Lampoon's Vacation" movies and his wife, Evegena, were booked for investigation of felony residential burglary and misdemeanor entering a building without consent.
The Quaids were released on $50,000 bail early Sunday. They are scheduled to appear in court Oct. 18, though a district attorney spokeswoman said Monday that charges hadn't been filed.
The couple's lawyer Robert Sanger would not comment.

The Hollywood couple accused of living in a Montecito home without permission are out of jail on bail.
Santa Barbara County Sheriff's Deputies say actor Randy Quaid was bailed out of County Jail at about 2:30a.m. Sunday. His wife, Evi Quaid, was bailed out of jail about two hours later.
The two were booked on felony residential burglary and misdemeanor entering a private home without consent charges. This past Saturday afternoon, deputies say they were called to a home on the 1300 block of East Mountain Drive. They say a caretaker of a home there reported someone living in the guest hours who was not invited to be there.
Deputies say they found Randy and Evi Quaid there. The couple reportedly told deputies they had owned the property since the 1990's. The current owner was able to provide ownership papers to deputies to prove they had bought the property in 2007.
Deputies say the Quaids were just living in the guest home; they had also caused thousands of dollars worth of damage.
The couple is due in Santa Barbara County Superior Court for an arraignment on October 18, 2010, but deputies say that is subject to change.
Evi was placed on probation in Santa Barbara County this past April. She had pleaded no contest to misdemeanor charges of defrauding an innkeeper, after the owners of the San Ysidro Ranch claimed the couple skipped out on a $10,000 hotel bill in 2009. Charges against Randy Quaid were dropped in that case.

Santa Barbara County Sheriff's Deputies have arrested actor Randy Quaid and his wife, Evi, after they were found squatting in a guest house in Montecito.
Deputies were called to a home in the 1300 block of East Mountain Drive around 2:15p.m. Saturday. A person representing the property had gone to the residence to check on a security alarm, and discovered someone was living in the guest house. When deputies arrived, the uninvited guests were not there. About four hours later, the property representative called deputies again, saying the people had returned. Deputies arrived to find Randy and Evi Quaid in the guest house. The couple insisted they have owned the property since the 1990's.
The current owner's representative was able to find the paperwork that shows the property was purchased in 2007, from a previous owner who purchased the property from the Quaids several years earlier.
A contractor estimates the Quaids caused around $5,000 in damage to the guest house while they were squatting there.
The Quaids were arrested for felony residential burglary, as well as misdemeanor entering a non-commercial building without consent. Evi Quaid is also charged with resisting arrest. Bail is set at $50,000 each.

The two already posted their $20,000 bail.
A Santa Barbara County Sheriff's spokesman say the couple should be coming back to Santa Barbara to face those charges in the next couple of weeks.
Randy Quaid, known for the National Lampoon Vacation movies, and his wife are accused of not paying a bill worth more than $10,000.
"They did post bail last evening, which means they were given a court appearance date, so they need to show back up here in Santa Barbara county," said Lt. Butch Arnoldi with the Santa Barbara County Sheriff's Department.
The San Ysidro Ranch has been in the county for decades and is a popular getaway spot for many celebrities. A spokesperson with the Ranch said they have "no comment" on the incident.
"We don't have to worry about extradition," said Lt. Arnoldi. "We don't have to go there and pick them up. They said that they're going to come here to California so that part of it, we don't have to worry about."
"We just look forward to them being returned to Santa Barbara so we can resolve it with them and their attorney," said Josh Lynn, the Chief Trial Deputy for Santa Barbara County.
Lt. Arnoldi says if the Quaids or their attorney do not show up for their court date, it becomes a larger issue.
"A bench warrant will be issued for their arrest and that's a whole new violation," Lt. Arnoldi said.
In another statement on TMZ, the Quaids said they have proof they paid their bill. A court date has not yet been set.
The Sheriff's Department said during the initial appearance, the Quaids would not have to be present. Their attorney could appear on their behalf.
