DA finds deadly officer involved shooting justified

Santa Barbara County District Attorney Joyce Dudley says the deadly shooting of a man by Santa Maria police officers last year was justified.

Robert Reyes, 36, of Nipomo, was shot and killed on August 2, 2012 after a car chase that ended on Highway 1 near Black Road.

According to the DA's report, Reyes was in a suicidal state that day. It says friends and relatives described him as being depressed about the death of his wife four months earlier.

The report says Reyes told his sister on August 2, that he was "tired" and "wanted peace".

According to the report, police dispatchers received several 911 calls that day about a man driving around Santa Maria, brandishing a handgun. The report says a police officer tried to stop Reyes' vehicle, but he drove off, leading officers on a chase through Santa Maria, Nipomo and Guadalupe. He finally stopped on Highway 1 after hitting a spike strip.

Police said Reyes then started to get out of his vehicle and pointed what appeared to be a handgun at the officers. Three officers fired at Reyes, killing him. According to the DA's report, that gun turned out to be a replica of a 9 mm pistol.

District Attorney Dudley says the officers acted reasonably in their use of deadly force.
