The home of a former medical marijuana dispensary owner escaped the auction block Thursday.

Charles Lynch's Arroyo Grande home was scheduled to be sold at a foreclosure auction this afternoon but it has been postponed until June.

Lynch says he has not been able to pay his mortgage.

It has been three years since deputies raided his Morro Bay dispensary and nine months since he was sentenced to one year and a day in prison.

California voters could legalize marijuana this November, but Lynch says that will not solve the confusion surrounding marijuana laws.

"Even if California does make it legal it's still going to be illegal against federal law, and so we still have the same dilemma," said Lynch.

Lynch is currently out of jail on $400,000 bail.

He plans to appeal his conviction and sentencing.
