Santa Barbara County prosecutors will seek a second trial for a former Lompoc prison guard charged with murdering another guard.
A jury in Santa Maria was unable to reach a verdict after Timothy McNally's first trial ended in April.
McNally is charged with second degree murder for shooting Gary Bent in a Lompoc hotel room in March of 2012.
Bent was in town for training.
Prosecutors say McNally shot Bent while they were both drinking at the hotel.
McNally claims it was an accident.
Bent was found dead with a single gun shot wound to the neck.
A new trial has been set for September 9th.
