The judge for the Timothy McNally murder trial might rule on the defense team's motion for a new trial Wednesday.
In October, a jury found the former Lompoc prison guard guilty of second degree murder.
He was accused of shooting and killing Gary Bent, another prison guard, in a Lompoc hotel room in March of 2012.
Prosecutors say McNally shot Bent while they were drinking at the hotel.
McNally claimed it was an accident.
That was the second trial for McNally. In April, a jury wasn't able to reach a verdict.
