This morning in a San Luis Obispo County courtroom a judge is expected to decide whether Patrick Wollett will be given a new trial.
Wollett was found guilty of killing 36-year-old Joshua Houlgate, but his new attorney claims he was not well represented during his trial.
The prosecution believes Wollett should not receive a new trial, but Houlgate's family has said they believe he should get one.
