San Luis Obispo will not appeal court order for homeless parking and sleeping case

The San Luis Obispo City Council voted 3-1 Tuesday in a closed session to not appeal a court order to pay $133,880 in legal fees to two attorneys who sued the city.
In July, the City of San Luis Obispo faced legal action for ticketing homeless people for sleeping in their cars without the proper ordinance.
In August, the city dismissed the tickets in a settlement agreement approved by the City Council.
Now, the city will pay more than $130,000 in legal fees to Stew Jenkins and Saro Rizzo, the attorney's representing the people ticketed. Back in January, the City Council said it would not give up the right to appeal unless the attorneys donate half of their legal fees to a local homeless service.
In an interview, one of the attorneys told KSBY that he did not have a problem with donating to help the homeless or any other cause, but he said he has a problem with how the City Council is going about pushing him to do it.
The city had 60 days to appeal the decision.
