Two convicted sex offenders, currently on parole, have been ordered to move out of a local sober living facility, following an investigation by KSBY.
They lived at Sunny Acres, located just outside of San Luis Obispo. The farm is also home to a pumpkin patch, visited by children, which is why the men were told to move out.
"The kids come out and college kids they like to get a pumpkin to fit into their festivities," said Dan DeVaul, founder of Sunny Acres. "Between this and the Christmas trees it plays a big role in funding our program."
A KSBY investigation, and a quick search of Megan's Law, revealed three convicted sex offenders were living on the property where the pumpkins are being sold. Two of them were convicted of lewd acts with a person under the age of 14.
"Well number one, they're over there at the house and the pumpkins are over here," said DeVaul, pointing at the sober living home about 1,700 feet away. "We're probably not going to have them out here front and center to be waiting on the kids or anything like that."
According to law enforcement, their proximity to children searching for the perfect pumpkin is a concern.
"In general they have to stay 2,000 feet away from any place where children congregate," said San Luis Obispo County Sheriff's Office spokesman Tony Cipolla. "That could be bus stops, schools, playgrounds. Pumpkin patches, though, that's a gray area."
According to California law, those requirements do not apply if the sex offender is not on probation or parole.
"There have been more problems from sex offenders that are living in the creek in San Luis Obispo than there have been at Sunny Acres," said DeVaul.
