Victim identified in highway 101 fatal accident

We're learning more about a bizarre highway accident that left one man dead and another charged with drunk driving. It happened Saturday night, in San Luis Obispo.
Forty-nine year-old, George Patton of Fresno was driving his BMW southbound on highway 101, when he hit and killed, 22 year-old, Ismael Gamboa.

Investigators say, a fight broke out among the people traveling inside of a Suburban where Gamboa was a passenger.
The people in the vehicle told investigators, Gamboa tried several times to jump out while they were traveling down the highway. The driver pulled over to calm Gamboa down. That's when officers say, Gamboa got out of the car and ran directly into traffic.

Further investigation showed that Patton had a blood alcohol level just above the legal limit. California Highway Patrol Officer, Joe Vega says, "Although he (Patton) was determined not to be the primary cause of this collision he was found to be under the influence of an alcoholic beverage and operating a motor vehicle."
Patton is charged with misdemeanor drunk driving. Investigators believe Gamboa was also under the influence. But, they are waiting on toxicology results for confirmation.
