State of California, Caltrans sued in deadly 2018 crash at Cholame “Y”

The family of a man who was killed in a 2018 crash near the Cholame “Y” is suing the State of California and Caltrans.

A wrongful death lawsuit was filed Tuesday in San Luis Obispo County Superior Court.

The crash happened on April 6, 2018, in an area a quarter-mile west of the intersection of Highways 46 and 41. Four cars were involved.

Two drivers were killed and nine others were injured.

The drivers who died were identified at the time as Catherine Ann Fox, 60, of Paso Robles and Jesus Ontiveros, 45, of Tulare.

The lawsuit is filed on behalf of the family of Ontiveros. It claims negligence and says the roadway was not designed or maintained properly.

The lawsuit also says the roadway didn’t have signs advising drivers about traffic pattern changes, barriers, or center line rumble strips.

The family is seeking damages exceeding $25,000, arguing the plaintiffs suffered wage loss, loss of property, hospital and medical expenses, property damage, and loss of earnings among other damages.
