Update -- The attorney representing the family of a man who died in San Luis Obispo County Jail in 2017 told KSBY News Wednesday afternoon that his client rejected the county's settlement offer.

James McKiernan said the nearly $42,000 settlement agreed upon on October 11 was contingent on approval from the Board of Supervisors. After further consideration, he said Dorothy McLaughlin, Kevin McLaughlin's elderly mother, decided not to accept the settlement.

McKiernan said he notified County Counsel of the decision the day of the supervisor's meeting, October 22, during which the board accepted the settlement.

Assistant County Counsel Nina Negranti said the agreement was signed by the plaintiffs and their attorney and the County intends to make a motion with the Court to enforce the settlement.

Kevin McLaughlin's family claimed in the lawsuit jail staff failed to provide emergency treatment for heart attack symptoms that caused the 60-year-old's death in May of 2017.

San Luis Obispo County has settled a lawsuit filed by the family of a man who died in the San Luis Obispo County Jail.

The suit claimed jail staff failed to provide emergency treatment for heart attack symptoms that caused 60-year-old Kevin McLaughlin's death in 2017.

The County says the lawsuit was settled earlier this month.

McLaughlin's family was paid nearly $42,000, records show.

KSBY has reached out to the family’s attorney for comment but has not yet heard back.
