Suspects in Oceano homicide are gang members, sheriff says

UPDATE (4:17 p.m.) - The San Luis Obispo County District Attorney's Office announced Monday afternoon that Robert Joseph Garay, Gabriel Luis Garay, and Nathaniel Alexander Jara have officially been charged with first degree murder for the shooting death of Daniel Fuentes Sr.

The complaint against the three men alleges that they committed the murder in association with the Oceano 13 gang and that Robert Garay was the gunman.

The three men are scheduled to appear in court for arraignment on Tuesday morning.

(11:07 a.m.) - San Luis Obispo County Sheriff Ian Parkinson says three men arrested in connection with a homicide in Oceano this past April are members of the Oceano 13 gang.

Daniel Fuentes Sr., 41, was shot and killed in Oceano just after midnight on April 3, 2019. Sheriff's officials say he died at a neighbor's home in the 2200 block of Beach St. after knocking on the door and asking for help.

As KSBY News first reported on Saturday, Robert Joseph Garay, 28, Gabriel Luis Garay, 21, and Nathaniel Alexander Jara, 21, were booked into the San Luis Obispo County Jail last week on charges including murder and participation in a criminal street gang.

Sheriff Parkinson said during a press conference Monday that Fuentes Sr. had been previously associated with gang members but was not currently a member of a gang. He said he couldn't discuss a motive for the murder at this time but that it was gang-related.

The victim's son, Daniel Fuentes Jr., told KSBY on Saturday that he attended Arroyo Grande High School and Mesa View Community School with Gabriel Garay and Nathaniel Jara.

"We are coming to terms with it," Fuentes Jr. said. "We are getting to a point where we might have to go to court and make sure they get the proper punishment."

Robert and Gabriel Garay currently live in San Luis Obispo, according to the sheriff. Jara lives in Avila Beach.

The San Luis Obispo County District Attorney's Office is expected to officially file charges against the three men by the end of the day on Monday, and they will be arraigned on Tuesday.
