Police find driver not at fault for Grover Beach collision that killed pedestrian

The investigation into a collision in Grover Beach near the beginning of the year that killed a pedestrian is now complete.

It happened the evening of Jan. 21 near the intersection of Brighton Avenue and North Oak Park Boulevard.

Police Chief John Peters says the pedestrian, identified as Justin Dean Truman Kissinger, 33, of Arroyo Grande, “walked diagonally in a northern direction from west to east, clearing the two southbound lanes. Then, having narrowly escaped a vehicle impact on the first northbound lane, the pedestrian’s unexpected appearance in the second northbound lane resulted in him being accidentally struck by another vehicle.”

Police say Kissinger was wearing dark clothing and was also intoxicated at the time.

Peters says it was determined Kissinger’s “impaired judgment due to high levels of intoxication” and attempt to cross the street illegally led to the collision.

No charges will be filed against the driver.
