Man arrested in Morro Bay after police say he struggled with officers

Morro Bay police arrested a man who they say struggled with officers and grabbed an officer's gun.

Police say officers were called to the Tidelands Park boat launch area Tuesday evening for a report of two men fighting. They say the first officer on scene found a man lying face down on the boat dock. He was reportedly wet and having difficulty breathing.

Police say a second man, identified as Justin Seymour Porter, 33, was standing over the man, yelling and screaming. They say Porter grabbed the officer when the officer tried to help the other man.

During the struggle, police say Porter fell into the water but was pulled back onto the dock unharmed and taken into custody.

Police say as officers were trying to put Porter in the back of a patrol car, he began to resist and grabbed an officer's holstered firearm. They say the officer was able to keep the gun holstered during the altercation and no one was hurt.

According to the police department, Porter was found to be drunk and under the influence of drugs.

He was booked into San Luis Obispo County Jail on charges including assault on a peace officer, public intoxication, being under the influence of a controlled substance, and providing a false name. He was being held on $25,000 bond.
